Starting A Business? You Should Seriously Consider Consulting An Orange County Attorney…

October 6th, 2009

Starting a business can be a daunting task and if you are planning on starting a business in Orange County, then I would highly recommend consulting an Orange County Attorney even before you take that first step.

Considering Seeing An Orange County Attorney

Before seeing an attorney, there are a few things you should consider.

First, take a good hard look at yourself and the business you are considering starting and ask this question. Is entrepreneurship right for me? And then ask, is this business the right kind of business for me?

If you answered, yes, to both of these questions, then there are some resources that can be of great help to the individual who is looking into starting their own business especially for the first time.

First is a checklist for starting a business from the Small Business Administration (SBA), and the second checklist for starting a business is from the Internal Revenue Service (IRS).

Now that you have done your research and decided to move forward with your new business venture, the first thing I would want to consider, is what type of business structure is the most appropriate for your new business.

There are several types of business structures to consider depending on the type of business you are starting. This is where the advice of an Orange County Attorney could be some of the most important advice you could ever get in regards to your new business and can really come in handy. Some of the most popular are the Sole Propriatorship, S-Corporation, C-Corporation, Non-Profit Corporation, Partnership, Professional Corporation, and LLC.

Truth is, I could go on and on about the reasons to see an Orange County Attorney before starting your business, but if you have read the checklists mentioned above, well, then you should be pretty up to date by now anyway.

Good luck with your new business venture, I wish only the best for you and your new business, so whatever you do, before you start spending a lot of money putting your new business venture together, for goodness sake, see an Orange County Attorney. It could end up saving you thousands, if not hundreds of thousands of dollars and some attorneys will talk to you about starting and setting up a business as a free consultation, so what have you got to lose.

An attorney is a MUST. I tried it without thinking “Oh this cannot be that hard…”
Nope not hard….. but the money it took to fix the little problems would have far been saved by having the attorney to find the little glitches BEFORE they occurred!

This article tells it exactly how it is. When starting a new business in Orange County the advise here is priceless. Go to the websites listed and get the checklists but before you complete everything on the lists get legal advise.

Entity choice is so much more than putting Inc at the end of your business name. The advise on the best possible choice for your business is available if you just ask. Tax myths and LLC vs Corporation myths are everywhere it’s worth what ever is charged not to make a costly error.

Having a legal team help you make a choice and follow the rules is something that you will really appreciate once you are making money with the business of your dreams.

I’m confused as to which Orange County this is referring to. I know there’s the widely known Orange County, California, but I also live in Orange County, Florida.

Was wondering if you could please clarify which OC this is.

This article made me realize that it is a very good point to hire an attorney when you have your own business. It is actually something I haven’t thought before, but now that I read about it, it’s clear what a good idea it is and how essential it is to protect your business. If I were still living in California, I would check out the attorneys listed on this page.

This is a very informative article. It not only tells you where to find a good, qualified legal team for your business, but also gives you not 1 but 2 checklists that are also packed with information. If you are a business owner, or wanting to become one, I would definately seek the advise of an Orange County Attorney, and follow the information located in this excellent article.

I’ve been looking into starting a business for a few years and have put it off every time when I start to face the legalities of everything. I can handle the work, the long hours and incredible dedication it would take, but every time I come to the legal part of it, I worry that I might do something wrong and ruin all the work I put into it.
I didn’t realize that lawyers do free consultations on this type of thing! That’s great to hear, I think I’ll pull out all the old files and look this over once more.

Great article! I agree with you on consulting with an attorney before moving forward with any business plans. I have a friend who’s looking to start up his own pressure washing business. I’m gonna have him take a look at this article. Thank you.

This is fabulous information! I have owned two small businesses in my lifetime. The first time was as a partnership. The gal was a close friend and I thought an attorney would not be necessary. After all, I had known her for years, and spent a lot of time at her home and with her family. What could possibly go wrong? Ha! Long story short, she ended up filing a personal bankruptcy and ALL the debts of our business fell on MY shoulders! I spent years paying it off – because I had “trusted” her, we didn’t have anything in writing. If only I knew now what I didn’t know then! I can’t stress strongly enough the value of discussing your business plan with a competent attorney. Don’t be like me! Invest the time and the small amount of money upfront to save the pain and heartbreak of potential pitfalls in the future!

Aside from the help available with getting your corporation set up, it is always a good advice to speak with a local attorney when setting up a new business. Even if this is not your first business, often there may be additional ways that an attorney can be of help by solving issues before they become problems. Examples of this would be that different geographical areas or industries you are new to may have different ordinances, requirements for licenses and permits, restrictions etc.

I have seen this happen first hand. A friend wanted to expand their retail store, which was doing well, to a second location in a new small town. They leased a property and proceeded to install the same exterior sign they had used at the first location. They ran into a lot of problems with this and got a bad image locally. The new building location was in a downtown area that had been “historically renovated”. It did not allow for exterior signs that measured over a certain size, or had flashing lights on them.

Since it was directly across from the courthouse this came to immediate notice, and was even written up right away in the local paper as an “eyesore”. The local downtown preservation society had a field day with smearing the “eyesore” of a new store, and public opinion was not pacified even after the offending sign was removed. This is NOT the type of advertising a new store wants.

Had my friend talked to a local attorney first, she would have been warned of those rules. She then could have made the choice to have leased another building, or used a different and more appropriate sign for that area. This would have saved her from getting a bad image before even opening. As it was, the store never did well. She ended up closing it, and moved to another second location in another small town. Before doing so, she talked to a local attorney to see if any such rules existed.

I think that it is always helpful to seek legal advice before starting a business venture. Not only can an attorney help advise you with all the legal issues that need to be covered, they can help you save money by avoiding costly mistakes.
